Ketidaksesuaian Promosi Instagram Richeese Factory Ditinjau melalui Undang-Undang Perlindungan Konsumen

Abstract

Promotion is a way companies use to communicate with consumers to convey information about the products they sell to attract consumers to buy their products; Richeese Factory also does this on Instagram social media by creating an Instagram account named @ richeese_factory. However, the high enthusiasm of consumers for the products promoted by Richeese Factory on Instagram is, in fact, not in line with the points that occur when consumers visit these fastfood restaurant outlets. This research analyzes how Law Number 8 of 1999 concerning Consumer Protection (UUPK) provides legal protection if business actors carry out inappropriate and incorrect promotions and what Richeese Factory's responsibility for wrong promotions is. This study uses a normative method by analyzing a literature study in Law No. 8 of 1999 concerning Consumer Protection and other relevant sources. The UUPK has regulated the prohibition of carrying out promotions/advertisements containing inaccurate information and the prohibition of carrying out promotions as if the products being traded have discounted and special prices. So in this research can be concluded that UUPK can provide legal protection to consumers and ask business actors to carry out their obligations in fulfilling promotions carried out to protect the rights of consumers who are harmed by inappropriate promotions, and business actors can be subject to administrative sanctions if proven to have deliberately violated UUPK.
