Abstract

Health is a necessity for everyone in this world, treating diseases is considered expensive so they will choose to maintain health through early prevention and living a balanced lifestyle. All diseases will be recorded by doctors and then referred to as medical records. Patient Health Data is as important as personal data or identity so it needs to be protected and it is the patient's right to maintain its confidentiality. However, there are rules that can open access to confidentiality for the sake of interest so that the hospital is obliged to disclose the patient's medical record. The research method used is a qualitative descriptive method which uses laws and regulations and journals in conducting analysis in this study. The result is that law enforcement in court or at the request of institutions / institutions listed in the Law can have access to disclose the confidentiality of medical records. This also includes BPJS which is a legitimate State institution under the Law. However, each party needs to follow the pattern of mechanisms that have been described in the Minister of Health Regulation in order to provide maximum protection for these medical records from leakage and misuse
